Terms and Conditions
In these terms and conditions the following applies:
- 'Conditions' means these terms and conditions of sale.
- 'Contract' means curtains, blinds, cushions and any other goods supplied by us following your order.
- 'Goods' means curtains, blinds, cushions and any other goods supplied by us following your order.
- 'Order' means an order by you for the supply of Goods by us.
- 'Price' means the price of the Goods plus any delivery charges.
- 'Our, us, we' means Curtain Choice whose place of business is 8 Church Close, Black Bourton, Bampton, Oxfordshire OX18 2PG.
- 'You and your' means the person who buys or agrees to buy Goods from us.
By clicking on purchase at the checkout section of the website, you are undertaking to buy the Goods at the Prices indicated. An order taken over the telephone is final once payment has been taken and the call ended. As all our goods are custom-made, we require payment in full at the time of placing the order. You can pay by credit or debit card on the website or over the phone by giving us the relevant details. An order will not be processed until we have received payment in full.
Every effort is made to represent our fabrics on the website as accurately as possible, but there may be differences between the digital image and the actual fabric. We strongly recommend that you order a free sample/s to check the colour, texture and design of the fabric. We will not be liable for any variation of the fabric between either the digital images on our website, the samples, or the finished product.
All our goods are made to the specification provided by you and we cannot accept returns for goods due to incorrectly supplied information. Please see our measuring guide before finalising your order. Whilst we make every effort to supply goods to the exact measurements supplied by you, please note that due to shrinkage, movement, pattern matching and curtain/blind making techniques, we will not be liable for any difference of up to 1% or 2cms, whichever is the greater, between your stated measurements and the finished product. Returns are only accepted if the item is significantly defective. All goods should be checked upon receipt and defects or damage reported to us by email or telephone within 24 hours.
Details of our prices are clearly displayed on our website and are the prices in force at the date and time of ordering. We reserve the right to change the price of any product before you place an order, or to withdraw a product or fabric from sale at any time. After placing an order with us we will email a confirmation of the order in writing. If you do not receive this confirmation you must notify us within 24 hours of placing the order. You must also notify us by telephone of any errors in the order within 24 hours of receipt of the order confirmation. If you fail to do so, we shall be entitled to assume that you are satisfied with the Order as detailed in the confirmation. We reserve the right to charge for any changes which you request after the 24 hour deadline has passed. Custom made goods are not subject to Distant Selling Regulations, therefore it is important that the information you send us is accurate. You may cancel an order for any reason within 24 hours of placing it and receive a full refund.
Your order will be despatched to you approximately 4 weeks from the date of placing your order, unless there is a delay due to circumstances beyond our control. You will be notified by email of the despatch date of your goods and your order will arrive by courier on a weekday between 9a.m. and 5p.m. The package will need to be signed for. If the courier is unable to deliver to the address you have provided and the package is subsequently returned to us, then you will become liable for all additional delivery costs associated with resending the goods to you.
All our goods are checked carefully at each stage of production and again before being packaged. Bespoke goods may not be returned to us unless there is a significant defect in the fabric or production. Defects caused by neglect, misuse or accidental damage will not count. You shall not be entitled to reject the goods where the alleged defect or breach of contract is so slight that it would be unreasonable for you to do so. If after checking, you find that your goods are defective or damaged, the goods may be returned to us for inspection. The cost of return is at your expense and we do not accept liability for any package lost or damaged in transit. You must obtain a returns number from us to be included in the package before you send it back to us.
The contract shall be governed by the laws of England, and the customer agrees to submit to the non-exclusive jurisdiction of the English Courts.
